I choose to participate voluntarily as a Rider or Volunteer in the Great River Energy/Mesabi Trail Tour for the purpose of raising funds Independent Public Radio and the Mesabi Trail. My participation in the Great River Energy/Mesabi Trail Tour is my own idea and is of my own free will without any compulsion whatsoever.
I understand that the Great River Energy/Mesabi Trail Tour is a non-competitive, long distance fundraising ride. I understand that the Great River Energy/Mesabi Trail Tour will involve extensive travel by bicycle and additional related events, including but not limited to dinner, entertainment, artisan displays, and cultural/interpretative attractions. I recognize that participation as a Rider and/or Volunteer in a long distance bike ride is very dangerous and involves the risk of serious injury and/or potentially extensive medical and rescue expenses. I further recognize that the bicycle trip may be a long way from hospitals, doctors, and pain-relieving medicines. I represent that I have experience with biking so as to be adequately prepared to engage in a bike ride of this nature. I represent that I am in good health so as to allow me to take part in this bike ride as a Rider and/or Volunteer.
As lawful consideration for being permitted by Club Mesabi, Inc., Inc. to participate in the Great River Energy/Mesabi Trail Tour, I hereby for myself, my heirs, administrators, personal representatives and assigns, forever release and discharge (Club Mesabi), Inc., Great River Energy, Mesabi Trail, the St. Louis and Lake Counties Regional Railroad Authority, the Mesabi Trail, The Costin Group, Inc., Independent Public Radio and any new benefiting agencies, their owners, shareholders, directors, officers, employees and agents (collectively the "Released Parties") from any and all liabilities, losses, costs, claims, demands or causes of action (collectively "Liabilities"), that I may hereafter have for death, injuries and damages arising out of my participation as a Rider and/or Volunteer in the Great River Energy/Mesabi Trail Tour, whether caused by any negligence, active or passive, of the Released Parties or otherwise.
This agreement will not apply to willful, wanton recklessness or intentional acts of the Released Parties.
I acknowledge that the Released Parties have never expressly or impliedly assumed any responsibility for me as a Rider and/or Volunteer during the Great River Energy/Mesabi Trail Tour or for any fundraising effort or other activity connected to my participation in the Great River Energy/Mesabi Trail Tour and any other activity connected therewith. I represent hereby for myself, my heirs, administrators, personal representatives and assigns that I wish the Released Parties to be the beneficiary of any funds I may pay and do not want the Released Parties to have any liability for any aspect of my payment. To that end, I agree to obtain comprehensive medical insurance and to pay the full cost there under to cover all potential risks of this fundraising endeavor.
I acknowledge that I alone am responsible for my personal safety, the condition of the bicycle or transportation device I will be riding, and all personal property I bring with me. I understand that I am solely responsible for my bicycle, vehicle, and personal property, which means that none of the Released Parties will be responsible for the safekeeping or custody of any such property. I hereby for myself, my heirs, administrators, personal representatives and assigns, forever release and discharge the Released Parties of any liability that may arise out of any act I commit resulting from my participation as a Rider and/or Volunteer in the Great River Energy/Mesabi Trail Tour.
Because bicycle riding is dangerous, I agree to ride safely at all times. I also agree to wear a helmet certified by ANSI, Snell, CPSC. Or ASTm, whether during the Ride itself or on training rides.
I understand and recognize that I am not, nor have I ever been, an agent of the Released Parties in connection with this activity and that none of the activities connected with the Great River Energy/Mesabi Trail Tour, including fundraising activities, constitute a joint venture or enterprise of any type with the Released Parties. I agree not to represent myself to third parties as an employee or agent of the Released Parties.
I understand and agree to the use of my name, photograph, voice or likeness by the Released Parties, their licensees, affiliates and employees. I consent to and authorize in advance such use and waive my right to privacy I have connection therewith.
I understand that this is an outdoor event and the event, food, entertainment, and events will be subject to the weather and my registration fee is non-refundable for any reason, including weather related cancellations or postponements of all or part of the activities associated with the Great River Energy Mesabi Trail Tour.
I have carefully read the above release and agreement prior to its execution, and I am fully familiar with the contents thereof. I agree that this release and agreement will be governed by Minnesota law and is intended to be as broad and inclusive as permitted by the law of Minnesota, and that if any portion of it is held invalid, the balance shall, notwithstanding, continue in full legal force and effect. This release shall be binding upon myself, my heirs, administrators, personal representatives and assigns, forever.
I UNDERSTAND THAT THIS IS AN IMPORTANT LEGAL DOCUMENT. BY SUBMITTING THIS FORM, I REPRESENT THAT I HAVE READ THIS DOCUMENT CAREFULLY AND IN FULL, THAT I AGREE TO ALL OF ITS PROVISIONS, AND THAT I SUBMIT THIS FORM/AGREEMENT OF MY OWN FREE WILL.
I hereby warrant that I am at least 18 years of age and have the right to contract in my own name

I am a Parent/Guardian of one or more participants of Minority Age, under age 18 at the time of registration.
This is to certify that I, as parent/guardian with legal responsibility for any minor child participants listed above, do consent and agree to their release as provided above of all the Releasees, and for myself, my child and our heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasee from any and all liabilities incident to my minor child's involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.
